Casino Law Hinges on Massachusetts High Court Case

BOSTON (AP) — The fate of casino gambling in Massachusetts may hinge on a case before the state’s highest court.

The Massachusetts Supreme Judicial Court is set to hear arguments Monday over an effort to place a question on the November ballot asking voters whether they want to repeal the state’s 2011 casino law. The court is expected to issue a decision by July.

The anti-casino group Repeal the Casino Deal is challenging state Attorney General Martha Coakley’s ruling that the proposed question violates the state constitution because it would result in an uncompensated taking of private property from casino developers.

But the group argues that the state and its voters have the right to revisit laws impacting “public morals and welfare” at any time.
